What To Do About Harassing Creditor Phone Calls

 

        At least sometime in our lives we all run into a Debt problem.
The question is what to do about it. This article offers practical
and real solutions you may be totally unaware of.
 So I will get right to the point.

 Number 1: You can stick your head in the sand and pretend that everything is fine and you do not owe anybody any money.

This solution usually winds up with a horrible credit score,
 non stop phone calls that seem to follow you wherever you go.
 That would be work, school, perhaps  even church.

 The bottom line is not good.
 

Number 2: Simply wait until one day you find that maybe a few thousand dollars is missing from your bank account or accounts.
Trust me, I know what I am talking about. As long as
 your income is not made up of what is called exempt funds, then yes they can do it.

 

Number 3: Now, here comes the good news! Every harassing
phone call is actually worth money to you. And potentially, a lot of it. Before you finish reading this article you will learn about something
called cash for calls. Yes, exactly what it sounds like. Those harassing calls where Debt Collectors use the telephone to try to wear you down by calling you all times of the day or night, or calling you at
your place of business, or many other things that they hope will squeeze a payment out of you.

       

            If they are able to get a payment from you for any little amount of money, then they may restart the clock on the statute of limitations. E.g. That means if the SOL was about to run out in your state, lets say 4 years on unsecured debt, then they get another 4 years to legally try and collect the debt. If you do not give them any money, then the ballgame is over, in terms of the collector legally trying to collect the debt. Yikes!! No only that, but you can turn around and
sue them and get rather large awards of money from them. We have firsthand knowledge of consumers who have been awarded as much as 90,000 dollars for FDCPA violations.

       To do this you first , have to find someone who is familiar with how to teach you what you need to document collector calls, and then follow their instructions.

not money from a windfall, although it can feel that way.

American Debt Enders Answers What Is The Debt Invalidation Process?

This is part one of a two part article explaining exactly what debt invalidation is.
The above question is a popular inquiry on Google and all other search engines. So time to really delve into it. Their may be some variations on each companies approach, but overall this article will provide you with a thorough understanding about this process which is becoming more popular. First, what it is not. It is not illegal, it is not a scam, it is not immoral, it is not Debt Settlement, or Bankruptcy. Secondly, the company you hire to represent you and your interest does not have to be a law firm, although it is good to have an Attorney involved in the process, or at least on standby, should one become necessary. We will cover this in more detail later on. By the way, American Debt Enders is not a law firm and does not give legal advise. For all the trouble makers on the internet, providing information and education about law, is not the practice of law.

Despite what most consumers believe, one does not have to have a BAR card to be an authorized representative for another person. Contrary to popular belief, there are no laws against appointing a personal authorized representative to present your interests in a claim or dispute.  It would be against all American equitable principals to create laws that would prevent a free man or woman from appointing an authorized representative, or agent, to act on their behalf.  Other terms for a personal authorized representative may include, power of attorney, trustee, executor and agent to name a few.  Sorry lawyers.

Next Item. Why Dispute A Debt? A debt should be disputed to make a debt collector prove they have the right to collect on a particular alleged debt. Their is absolutely nothing illegal or immoral about doing this.
It is the law that makes it possible. For clarification, I do not and would never recommend using this method to avoid a debt you know is valid and that you really owe and can afford to pay.

When a debt collector sends a notice of a debt owed to a consumer they are making a claim against that consumer. Note:(this article is based on researching the debt dispute program as laid out by Infinity Consumer Services, which contains some unique elements.) When you the consumer dispute the debt you are making a counterclaim, the claim and counterclaim create a commercial record of both. right at the outset of the dispute. The following information must appear on all notices for collection sent to a consumer. “…unless you dispute this debt within 30 days of receipt of this letter, we’ll assume the debt is valid.” Please notice the word Assume. If all debts were valid without assumption than their would be no need for any laws governing the rules for dispute.

No, not the John Lennon song (I never agreed with the premise, but as a songwriter myself, I did like the melody). If all you do is read this article and feel good for a moment, I won’t have accomplished my goal. Every day, I listen to people describe their debt situations in order to allow me to help them, and make no mistake, I count it a privilege to help them.

You see, I have been through my own debt struggles, and I have yet to meet anyone whose financial problems were as bad and complicated as my own. I’m not ashamed to say this. It is the reason I work so many hours each day one-on-one with people who are hurting financially. You see, there is no such thing as only hurting financially. Financial problems are like an ill-fitting pair of shoes: the problem affects your whole body. To take the analogy further, financial oppression day after day affects your entire outlook on life.

Remember, I’ve been there. If you can relate to anything I’ve said so far, then just imagine. Imagine that, as you begin another day, you realize that you have the resources to pay your housing, clothing, and food bills with no real struggle involved, and the only time the phone rings is when a friend is calling. I’m not being cute. Would it affect your outlook? Perhaps put a little spring in your step? Yes, it would. Almost every phone call I receive as a credit counselor is from a consumer struggling to try and do the right thing by paying back their credit card debt on which the interest rate has risen to 29.9%. One day the awakening comes that minimum payments at that interest will take thirty years to pay off, here is an example using our credit card interest rate calculator: A 10,000 balance at 29.9% interest and a usual minimum payment of 220.00 dollars (this represents 2.2% of the balance and is standard in the banking industry, will not payoff in your lifetime.  It will also cost you over 25,000 dollars just in interest! Ouch. The above numbers are facts, just like two plus two equals four every time. So you say, I thought the “Credit Card Reform Act of 2009” stopped this from happening. Well, not exactly, like everything else in Washington, the act used slight of hand. It merely said that the banks had to give you a notice that your interest rate was about to go up ,and if you failed to respond by closing the card, it would. So why didn’t you jump to respond? Is it possible you were so busy trying to run your busy life that you simply did not see it? Of course. Believe me, as a ten year consumer advocate who started in the non nonprofit industry, I am on your side.

 So, lets get to the bottom line. Once you have figured all this out, your first step is usually to call the credit card company and make an appeal. Surely, you think they will be reasonable. You very quickly realize that nothing could be further from the truth. It will be like talking to a wall. They are not in business to help you. The fact is, now, they love having you as a customer in this position. They have become your loan shark. You know, Uncle Vito from the neighborhood. The policy of all credit card companies is to say no to help.

 They, the banks  put in place 20 years ago debt consolidation programs called debt management programs, or DMP’s. These are the only structured programs that can fix your high interest rate, pay for life situation. You will lower your interest to single digits, pay off the credit card in 5 years or less, and maybe even lower the payment, and definitely save a literal fortune in interest by enrolling in one, which takes all of 15 minutes to do.  Since I was one of the first credit counselors on the internet to write about the credit score simulator that is freely available from Ikarma. If you are not familiar with the credit score simulator, it is a free service offered by Ikarma but has some limitations which I will explain how to overcome. To use it you simply visit Ikarma, create an account and first you can pull your free credit reports with a credit score. Then you can run the credit score simulator to see what changes you need to make to improve your credit score.

 OK, now that we are all on the same page, let me share what the drawbacks are when using the simulator.

First, there are a limited number of changes you can account for. You can see what your new score generally will be if you add or close a new credit card. Or, if you skip a payment. Get a new loan or have new credit inquiries, but that is about it.

 What you cannot account for is what happens if you are able to completely remove a negative trade line, like something that is in collections. This is something that would be extremely helpful to raising your credit score.

  When people shop for mortgages the first thing they ask is what is the rate and what is the payment. Makes perfect sense, as this is really what matters in a mortgage and there is wide variability in these items as they apply to mortgages, not that many Americans are being approved for them these days. When people are seeking debt help,

 Whether it be settlement help or a debt management program, most of them do exactly the same thing. This absolutely does not make sense, and please allow me to state why.

 Lets take first a simple debt management program, what I call the high tech answer to Dave Ramsey’s debt snowball. This program was instituted by the banks over 20 years ago, shortly after they started charging usurious interest rates to consumers with credit cards. Since the banks new their would be higher default rates on these high interest credit cards, they came up with the genius idea of setting up non-profit companies to offer you the debt management program to lower your interest rates to lower the default rate and keep you from falling of the proverbial financial cliff.

 What that really means is that the banks did control and still do control that particular program completely. There is no negotiation of new interest rates or new monthly payments whatsoever. Every consumer gets the same new terms as every other consumer no matter what company they enroll through. Their terms are all the same, all the payments are handled by a processing company. The bank does not look at your payment history and say you have been a good payer in the past so we will provide better debt management program terms for you. OK, so I hope you have learned something about this type of program, and by the way, a debt management program goes by many names including debt consolidation. These programs are designed to get you out of debt in five years or less and save you a ton of interest but you must be able to afford the new monthly payment.

 If you are having trouble making your monthly payments and are in need of serious payment relief, then you may want to consider a debt settlement program.

 Is it wise to shop a bit when looking for a debt settlement program? Yes, because these are negotiated programs and even though the FTC stepped in with very strong regulations around the industry, there are still variations in this type of program.  How about a credit restoration program? Are you exhausted yet? Yes, these programs have become very popular for raising your credit score, and are quite legal. It is the subject of another article, as to how this is done.

OK, so the question is why do consumers wait until they
are up against it to seek out absolutely free counseling

I really think that it is just human nature that makes us all seek help

motivations for my articles. This one was inspired by an article
I read on Linked in written by Lori Regenstreich, who discovered
an original article from the New York Times written by Jessica Silver Greenberg
entitled “In Prosecutors, Debt Collectors Find A Partner”.

Essentially, the article reveals a rather nefarious partnership, and I use the
word partnership loosely, in which Prosecutors allow private debt collectors to send out letters on their letterhead threatening prosecutorial action unless the
consumer makes good on the debt, usually a bounced check.
Not only do the debt collectors ask the consumer to make good,
but they are also adding on usurious fees. Just imagine if you had
a business and were able to collect your accounts receivable this way.

them to focus on more serious crimes, and that the letters are sent only
to check writers who ignore merchants’ demands for payment.”

Does this remind you of the Southern sheriff from the movies, or what?

So here is the moral of this article. Can a credit counselor help you
with every debt situation? No. But a credit counselor probably can help you
if your situation is the result of to much debt and not enough money, which
often causes a snowball effect because of the denal problem spoken about earlier.

A good debt settlement program or consolidation program, not to mention
an online budgeting course can go a very
long way to easing the debt burden early on, before the legal issues
begin.
